1. Acceptance of Terms

By accessing or using Level America ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Description of Service

Level America is a gamified quiz platform that allows users to create, answer, and participate in trivia challenges related to American knowledge and general topics. The Platform includes features such as:

  • Challenge creation and participation
  • Coin-based reward system
  • State-based leaderboards
  • Dispute resolution system
  • User rankings and statistics

3. User Accounts and Registration

3.1 Account Creation

  • You must create an account to access most Platform features
  • You must select a U.S. state during onboarding
  • You are responsible for maintaining the confidentiality of your account credentials

3.2 Eligibility

  • You must be at least 13 years old to use the Platform
  • If you are between 13 and 18 years old, you must have parental consent to use the Platform
  • You must provide accurate and complete information during registration
  • You represent and warrant that you have the legal capacity to enter into these Terms

4. User Conduct and Content

4.1 Challenge Creation

  • You may create challenges in exchange for coin rewards
  • All challenges must include a question, correct answer, and explanation
  • Challenges must be factual, appropriate, and not misleading
  • You retain responsibility for the accuracy of your created content

4.2 Prohibited Content

You may not create or submit content that:

  • Is false, misleading, or intentionally deceptive
  • Contains hate speech, harassment, or discriminatory language
  • Violates intellectual property rights
  • Is sexually explicit, violent, or otherwise inappropriate
  • Promotes illegal activities

4.3 Challenge Participation

  • You may answer challenges created by other users by spending coins
  • You have 60 seconds to answer each challenge
  • Use of external assistance (search engines, AI tools) during challenges is prohibited

5. Coin System and Virtual Currency

5.1 Virtual Currency

  • Coins are virtual currency with no real-world monetary value
  • Coins cannot be exchanged for real money or transferred to other users
  • We reserve the right to modify coin balances for violations or system errors

5.2 Earning and Spending

  • Earn coins by creating valid challenges
  • Spend coins to participate in challenges created by others
  • Coin rewards vary based on challenge type and difficulty

6. Dispute Resolution System

6.1 Challenge Disputes

  • Only users who have answered a challenge may file disputes
  • Disputes must be filed within 24 hours of challenge completion
  • Valid dispute reasons include inaccurate answers, ambiguous questions, or regional bias

6.2 Dispute Limitations

  • Maximum 3 disputes per day per user
  • Rejected disputes result in temporary dispute restrictions
  • Repeated frivolous disputes may result in account penalties

7. Challenge Validation

7.1 Validation Process

  • Challenges become “valid” when answered by 9 users from at least 3 different states
  • Challenges with 50% or more valid disputes are marked as “invalid”
  • Invalid challenges may be removed from the Platform

8. Trust Score System

  • Your trust score reflects the accuracy of your disputes over time
  • Higher trust scores may influence future dispute considerations
  • Trust scores are calculated automatically and may affect Platform privileges

9. Intellectual Property

9.1 Platform Content

  • We own all rights to the Platform's design, features, and functionality
  • User-generated content remains owned by the creator but grants us license to use

9.2 User Content License

By creating challenges, you grant us a non-exclusive, worldwide license to:

  • Display and distribute your content on the Platform
  • Moderate and remove content that violates these Terms
  • Use aggregated data for Platform improvement

10. Privacy and Data Use

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

11. Platform Availability

11.1 Service Availability

  • We strive to maintain Platform availability but cannot guarantee uninterrupted service
  • We may suspend or terminate service for maintenance, updates, or violations

11.2 Feature Changes

  • We reserve the right to modify, suspend, or discontinue any Platform features
  • We will provide reasonable notice for significant changes when possible

12. Account Termination

12.1 Termination by You

  • You may delete your account at any time
  • Termination does not entitle you to refunds of virtual currency

12.2 Termination by Us

We may suspend or terminate your account for:

  • Violations of these Terms
  • Suspicious or fraudulent activity
  • Extended periods of inactivity
  • Legal or safety concerns

13. Disclaimers and Limitations

13.1 Content Accuracy

  • We do not guarantee the accuracy of user-generated challenges
  • Educational content is for entertainment purposes and should not replace formal education

13.2 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

13.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEVEL AMERICA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Content you create or submit

15. Dispute Resolution and Governing Law

15.1 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in the State of California, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

15.2 Class Action Waiver

YOU AND LEVEL AMERICA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.3 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15.4 Small Claims Court

Notwithstanding the above, you may bring an individual action in small claims court if your claims qualify and so long as the matter remains in such court and advances only on an individual basis.

16. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes through the Platform or email. Continued use of the Platform after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
